4A. Where information is collected instead, and by whom

This Website has no forms, no accounts, no chat, no uploads, and no checkout. There is nothing on it to type into and nothing on it to buy. Scheduling, intake, payment, and any future course purchase all take place on separate systems reached by a button, and those systems are described in Section 4A. Alafiora LLC therefore collects no name, no email address, no phone number, no payment details, no account credentials, and no uploaded files through this Website at all.

What the Website itself receives is limited to the following, and it is received automatically by virtue of a page being requested rather than because anyone submitted it:

  • Technical request data. IP address, browser type, operating system, referring page, and the date and time of the request. This is what any web server receives in order to send a page back, and it is retained only in the hosting provider's ordinary logs.
  • Measurement, and only where allowed. Where a visitor affirmatively allows measurement in the Cookie Preferences panel, the two tools named in Section 5 record which pages were read, how the visitor moved between them, and how a visit moved through a page, including scrolling, clicks, and cursor movement. Text and images are masked before any recording leaves the visitor's browser. Where measurement is not allowed, none of this is collected.
  • Browser storage set by this Website. Whether the opening animation has played in this session, any progress ticked on the Getting Started reading checklist, any reading preferences set in the accessibility panel, and the record of the cookie choice itself. Every button on this Website that gathers anything hands the visitor to a system outside it:

  • The compliance request form is a separate HIPAA-compliant hosted form, operating under a Business Associate Agreement.
  • Payment is processed by a HIPAA-compliant payment processor operating under a Business Associate Agreement. Card details never reach Alafiora LLC or this Website.
  • Any future course or digital product will be sold and delivered on a separate platform, with checkout handled by that same payment processor. Nothing of that kind is or will be hosted on this Website.

Information given to those systems is governed by the Notice of Privacy Practices where it is Protected Health Information, and by that system's own privacy terms otherwise. It does not pass through this Website on its way there, and reading a page here creates no record of a person.

5. Sources of Personal Information

Your personal information may be collected from the following sources:

  • Directly from You, when you complete forms, subscribe to services, create an account, or submit inquiries through our Website.
  • Payment Processors, such as Stripe or similar platforms, when you make a purchase or pay for services.
  • Measurement Providers. Where a visitor has affirmatively allowed measurement in the Cookie Preferences panel, measurement is provided by two services, and neither loads for any visitor who has not allowed it. Google Analytics counts which pages are read and how visitors move between them; the three Google advertising signals (ad storage, ad user data, and ad personalization) are denied permanently and are never granted by anything on this Website, so no advertising audience is ever built from who reads which page here. Microsoft Clarity records how a visit moved through a page, including scrolling, clicks, and cursor movement. Clarity is configured in strict masking mode, which replaces text and images before the recording leaves the visitor's browser, and the account is not linked to Microsoft Advertising, which is the connection that would otherwise let recorded browsing inform advertising. Nothing collected by either service is tied to a name, sold, or used to sell anything, and no visitor to this Website is a client of this practice by virtue of visiting it. No other measurement or analytics provider is in use on this Website.

6. Private Pay Practice and What It Means for Your Privacy

Alafiora LLC operates exclusively as a private pay practice. We do not bill insurance companies, submit claims to third-party payers, or participate in insurance networks of any kind. This means that your diagnostic information, treatment history, and session records are never transmitted to an insurance carrier or entered into a shared insurance billing system as part of your care at Alafiora.

Your payment records are maintained in our internal systems solely for the purposes of bookkeeping, documentation, and service delivery. They are not shared with third-party payers. If you choose to seek reimbursement from your insurance provider using a superbill we provide, the decision to share your clinical information with that insurer rests entirely with you, and we will make that choice clear at every relevant step.

For clients with meaningful privacy needs, this structure provides a meaningful distinction. Your engagement with this practice is not reported to any registry, insurer, or employer benefit system unless you direct it to be.

7. Telehealth, Electronic Communications, and Platform Security

Alafiora LLC provides psychological services through telehealth, utilizing HIPAA-compliant video conferencing and practice management platforms. The specific platforms we use may evolve over time as we continue to evaluate the best available options for privacy, security, and clinical quality. Platforms we have used or may use include, but are not limited to, CarePatron, Google Meet, Doxy.me, and Sessions Health. Regardless of which platform is in use at any given time, we require that all telehealth and practice management vendors meet HIPAA compliance standards and that Business Associate Agreements are in place before any PHI is processed through those platforms.

Standard email is not a fully encrypted medium. We encourage you to use the secure contact methods we make available for any communications that contain sensitive personal or clinical information. When you submit an inquiry through this Website, please be aware that general internet transmission carries inherent limitations in security. Dr. Lapite-Garrett will always respond through the most secure channel available.

Session Recording Policy. Sessions conducted through Alafiora are not recorded by Dr. Lapite-Garrett without your explicit written consent. If you wish to request that a session be recorded, you must submit that request in writing and receive written authorization before recording begins. If you choose to record any portion of a session on your own device, you must notify Dr. Lapite-Garrett prior to doing so, and you bear full responsibility for the secure storage and appropriate handling of that recording. Unauthorized recording of sessions is not permitted.

Your Responsibilities During Telehealth. The security of a telehealth session depends on both parties. To protect the privacy of your session, we ask that you join from a private location where you cannot be overheard, use a secure and trusted internet connection, and avoid public Wi-Fi networks or shared devices when possible. Alafiora LLC is not responsible for privacy breaches that result from the use of an unsecured device, network, or environment on your end. By participating in telehealth services, you acknowledge these conditions and accept responsibility for your end of the session environment.

8. Artificial Intelligence and Automated Tools

Alafiora LLC does not use artificial intelligence in any form for clinical work. This includes, but is not limited to, AI-assisted session recording, AI-generated therapy notes, AI-driven intake screening, or automated AI systems for clinical decision-making. Your sessions are conducted, documented, and reviewed by Dr. Lapite-Garrett personally, using her own clinical judgment and professional training.

Where our Website or administrative operations incorporate any automated tools, those tools are evaluated for privacy compliance before deployment and are used only for non-clinical functions such as scheduling, website analytics, or marketing communications. If this practice changes in a material way, this Policy will be updated accordingly. We believe that the absence of AI from clinical work is not merely a preference but a reflection of the standard of care our clients deserve.

Where AI is used, stated exactly. Because this Policy states plainly that AI is absent from clinical work, it should state just as plainly where AI is used, rather than leaving a reader to discover it elsewhere and wonder what else was left unsaid. AI is used in two places, both entirely outside of care: to draft marketing and educational copy for this Website, and to build document and process templates for the business side of the practice. The composite reflections and the narrative accounts that appear throughout this Website are drafted this way, and every page carrying them says so on the page itself.

In both uses, the AI tool has no access to protected health information, to client records, to session content, to intake or clinical disclosures, or to any personal information belonging to any client or prospective client. Nothing a client has said, written, or disclosed has ever been entered into such a tool, and no client information of any kind exists in anything AI has drafted. The people described in the reflections and accounts are invented. Dr. Lapite-Garrett writes them from her own clinical knowledge and expertise, and she reads and approves every word before it is published.

The distinction this Policy draws is therefore between the therapy room and the marketing copy, and it holds in both directions: AI has never touched a session, a note, an intake, or a clinical decision, and no client's information has ever touched the AI used to draft a web page or a template.

9. Limits of Confidentiality

While Alafiora operates with the highest standards of professional discretion, there are legal and ethical circumstances under which confidentiality has limits. These apply within the context of clinical services and are described fully in our Notice of Privacy Practices. We share them here in plain language as a matter of transparency:

  • We are required by law to report suspected abuse, neglect, or exploitation of children, elders, or other vulnerable individuals to the appropriate authorities.
  • We are required to take steps to protect the safety of an identifiable third party when a client presents a serious and credible threat of harm to that person.
  • We are required to respond to a valid court order or subpoena compelling the disclosure of records or testimony.

Clinical records maintained by Alafiora LLC are subject to federal HIPAA requirements and the specific mental health records laws of each state in which we are licensed to practice. We retain records for no less than the period required by applicable law, which may vary by state and by the age of the client at the time of service.

Requests to access, amend, or receive a copy of your records must be submitted in writing and will be processed in accordance with HIPAA and applicable state law. Please note that a request to delete personal information, while honored for website-related data where legally permissible, may not apply to clinical records where retention is required by law or is necessary for the ongoing protection of your health and safety.

Dr. Esther Lapite-Garrett is the founder and sole practitioner of Alafiora. There are no associates, no rotating providers, and no case handoffs: the person who reads a client's history in the first session is the same person still holding it two years later. She is licensed in New Mexico and Indiana, with additional state licensure underway.

Her training is doctoral-level, which typically extends several years beyond a master's-level license in assessment, diagnosis, and the treatment of complex, overlapping presentations. She keeps a deliberately small caseload so that depth is possible, participates in ongoing peer consultation and clinical training, and maintains her own personal therapy.
